12 Secrets to Winning a Disability Claim The procedure of collecting an insurance claim from an insurance company is not as easy and effortless as people might imagine it is. Just imagine: a person is physically injured due to an accident and he has to go through the long-drawn-out process of collecting insurance claim. Disability insurance companies claim they will support their customers in difficult times, but the truth can be very far from their claim, Attorney Jeffrey Hensley says. To have a captivating result, Hensley said, claims should be pursued with steadfastness, and with the right kind of representation. Hensley said he has 12 "secrets" that he considers being the most important in the winning chase of a disability claim. Follow these steps, he says, and the chances of success go up incredibly: Secret #1: Identify the problem (disability) when it occurs. People don't have to be ruinously injured or incurably ill to collect. Many policies offer money for partial disability as well. People should look for such things as loss of productivity, loss of income or the inability to perform the material and substantial duties of one's occupation. Secret #2: Notify the claim to the insurance company as early as possible. Late notice could result in a considerable loss of monthly benefits. Secret #3: Use multiple witnesses to identify the material and substantial occupational duties -- someone such as a co-worker or a vocational evaluation expert. The insurance company or jury must clearly understand the important occupational duties. Make sure witnesses identify and verify the duties of one's position. Secret #4: Identify and focus on the material and substantial duties that can't be performed due to physical or mental limitations. Once the insurance company or jury understands the occupation's requirements, it must understand what duties cannot be performed due to the disability. Secret #5: Document the loss of productivity with business records or even appointment calendars. The court looks for proof of the disability. Since memories often fade, it is important to present a case based on something other than one's memory. Written records, such as an appointment calendar -- and even a daily journal -- greatly increase credibility and give the jury the support it needs. Secret #6: Use business records and income tax returns to document loss of earnings based on loss of production. The bigger the loss, the more likely the jury will recognize the disability. Secret #7: Use past medical records to demonstrate the disability's onset and progression. Medical records provide accurate snapshots of symptoms and conditions. The better the doctor's documentation, the better the chances for a favorable jury decision. Secret #8: Maintain a regular schedule of medical treatment. Avoid lapses in treatment to occur. When insurance companies see lapses, they are likely to suggest that no real disability exists. Insurance carriers may suspend benefits in the absence of ongoing medical treatment. Secret #9: Identify and focus upon the physical limitations giving rise to the disability. The treating physician should understand and support the claim, since juries rely heavily on the doctor's evaluation and assessment. If the doctor does not support the claim, it may be time for a different doctor. Secret #10: If the jury rules against the disability, there may be grounds for appeal. Simply getting a bad result at trial is not grounds for an appeal, but there may be a chance of reversible error -- an error so significant that the judgment must be reversed by the appellate court. That amounts to grounds for an appeal. Secret #11: A loss in court does not stop you from filing of a new claim. Disability is a month by month contractual benefit. As medical conditions change, a new claim may be suitable. Secret #12: If an insurance company has acted in bad faith, that may open the door to additional money damages. Gypsum Corporation Establishes Asbestos Personal Injury Settlement Trust The US Gypsum Asbestos Trust started accepting claims in February. The trust was constituted under Chapter 11 of the U.S. Bankruptcy Code to handle asbestos related personal injury claims that United States Gypsum Corporation is legally accountable to. Early, Ludwick, Sweeney and Strauss, a New Haven, Connecticut based law firm specializing in mesothelioma lawsuits, is presently filing claims with the US Gypsum Company Trust on behalf of individuals who have been injured due to asbestos exposure. CARE Act Would Protect 500,000 Child Farmworkers The Child Labor Coalition (CLC) called for members of Congress to improvise the appalling conditions facing child laborers in American agriculture by pledging their support to new legislation. Under the Children's Act for Responsible Employment of 2007 (CARE Act), a new bill introduced today by Rep. Lucille Roybal-Allard (D-Calif.), protections for young farmworkers would be considerably increased for the first time since the enactment of the Fair Labor Standards Act in 1938. "I commend the Child Labor Coalition for organizing this important advocacy effort on Capitol Hill on behalf of children who work in our nation's agricultural fields," Rep. Roybal-Allard said. "I have introduced the CARE Act today to curb unfair child labor practices in agriculture that allow young children to work in dangerous conditions, and I am grateful for the Coalition's efforts to help pass this needed and long overdue legislation." Regardless of agriculture's ranking as one of the three most perilous industries in the United States, the law permits children to start working on a farm at a younger age and for longer hours than other working youth. The CARE Act raises protections for child farm workers to the same level as children working in other industries, boosts the maximum civil and criminal penalties for child labor violations, and strengthens pesticide safety provisions in agriculture to account for the higher risks pesticides pose to children and women. The bill preserves the family farm exemption, enabling children of any age to continue to work on their parents' farms. The briefing also featured Norma Flores, a former child farm worker, and Armand Pereira, Director of the Washington branch of the International Labor Organization. Besides, two CLC members introduced new educational materials on child labor in agriculture: In Our Own Backyard: The Hidden Problem of Child Farm workers in America, an online curriculum from the American Federation of Teachers (AFT), and Children in the Fields: An American Problem, a report from the Association of Farm worker Opportunity Programs. The Child Labor Coalition is a group of more than forty organizations that go all-out to protect working youth and to promote legislation, programs, and initiatives to end child labor exploitation in the United States and abroad.

A Blue Tooth Wireless Connection is Safer for Motorists Drivers are now required to use wireless headsets or a Blue Tooth wireless connection while talking on a cell phone while driving. This will take effect from Jan.1, 2008 and the cell-phone law in July 2008 and the state of Washington gave a green signal to this measure. This bill gives a message to all drivers all over the state that talking on your cell phone while driving is highly unsafe. States have taken action to cut down on cell phone related automobiles accidents. As per these new laws, drivers who read and compose text messages or talk on cell phone without hand-free device could face a $101 ticket. Some states ban the use of handheld devices while driving a motor vehicle, but they allow the use of some type of Blue Tooth Wireless Connection. Lawmakers, are scared of restricting cell phones in cars may hinder the advancement of new blue tooth wireless technology for cars that maybe helpful. Devices that can be useful for motorists include blue tooth wireless headsets, and blue tooth car kits. Richard Kovacs owner of Kovacs Wireless that sells blue tooth wireless connection products, doesn't want to outlaw cell phones in cars. He hopes they will be safer. "By being hand-free you can turn, you can shift, you can signal and most importantly you can see where your going all the time. Blue Tooth technology enables motorists to drive safer" he said.
